Public offer
The agreement you accept when placing an order in the dashboard. Written so you can read it without a lawyer — although a lawyer should still review it.
- The price is fixed in the order before payment — in hryvnia for Ukraine or US dollars elsewhere
- Revisions within the agreed scope are included in the stage price
- Money for undelivered work is refunded
1. General
This document is a public offer by the REDCODE studio (the "Contractor") to conclude a service agreement with any person who places an order through the client dashboard at site.4you.com.ua or signs a separate contract (the "Client"). Placing and paying for an order constitutes full acceptance of these terms. Projects with individual terms are covered by a separate contract, which takes precedence over this offer.
2. What we provide
- Website and web application development — at the rates described on the services pages, or by individual estimate based on a brief.
- Hosting — hosting the site on the Contractor's servers under the selected plan with recurring payment.
- Plugins — licences for the Contractor's software products under the terms stated on the plugin page.
- Domains — assistance with registering and renewing domain names on request.
- Maintenance and hourly work — at the rates on the respective service pages.
3. Placing an order
An order is placed in the client dashboard: the Client selects a service or plan, sees the final price and confirms the order. For development the basis is a submitted brief or an agreed specification; for hosting and plugins, the selected plan. An order is deemed accepted once the Contractor confirms it in the dashboard or by e-mail.
4. Prices and regions
Prices depend on the Client's region: for Ukraine they are shown in hryvnia, for other countries in US dollars. The region is detected automatically and can be changed by the Client with the switcher on the site before placing an order. The price shown at the moment of confirmation is fixed in the invoice and does not change within that order. Prices exclude VAT unless stated otherwise.
5. Payment
Development is paid in stages: an advance before a stage starts, the balance after its acceptance; the specific schedule is fixed in the order. Hosting and maintenance are paid in advance for the selected period. Plugins are paid in full before the licence is issued. For individual clients deferred payment is possible on terms agreed in the dashboard. Invoices are generated in the dashboard; the Contractor provides closing documents.
6. Deadlines and delivery
Stage deadlines are fixed in the order and run from receipt of the advance and all required materials from the Client. Delays in materials or feedback from the Client shift the deadline accordingly. The result of a stage is demonstrated in a staging environment; the Client accepts it or provides comments within 5 business days. Absence of comments within that period constitutes acceptance.
7. Revisions
Revisions within the agreed scope of a stage are included in its price — up to two rounds of comments per stage unless the order states otherwise. Changes beyond the agreed scope (new features, structural changes, rework of an approved design) are estimated separately and placed as an additional order.
8. Rights to the result
Upon full payment for a stage, exclusive rights to the code, design and content created within it pass to the Client. The Contractor hands over the repository, access and documentation. Rights to third-party open-source components are governed by their licences; rights to the Contractor's plugins by the plugin licence terms. The Contractor reserves the right to mention the project in its portfolio unless the Client objects in writing.
9. Refunds
If the Contractor has not started work on a paid stage, the advance is refunded in full. If work has started, the part proportional to the undelivered scope is refunded, less the work actually performed and accepted. Hosting fees are refunded for the unused period if terminated at the Contractor's initiative; if the Client cancels, by agreement. Plugin licences are non-refundable once the key is issued, except where the plugin does not work as described and the Contractor fails to fix it within 14 days.
10. Warranties and liability
The Contractor warrants that the result matches the agreed specification and contains no critical defects known at delivery; defects found within 30 days after launch are fixed free of charge. The Contractor is not liable for the consequences of changes made by the Client or third parties, for the operation of third-party services or for content provided by the Client. The Contractor's aggregate liability is limited to the amount paid for the relevant order.
11. Confidentiality
The parties do not disclose commercial information obtained during cooperation. Processing of personal data is governed by the privacy policy.
12. Dispute resolution
Disputes are resolved by negotiation; a claim is reviewed within 10 business days. If no agreement is reached — in court under the laws of Ukraine, unless mandatory consumer law of the Client's country provides otherwise.
13. Changes to the offer
The Contractor may amend the offer by publishing a new version on this page. Orders already placed are governed by the version in force at the time of their confirmation.
